California Sex Offender Management Board Recommends Changes to some Tiering
While the board recognizes the increasing number of convictions for online sexual offenses, including possession of CSAM, they note a study published in 2023 by "Helmus" indicating that their appears to be only 5% recidivism rate for those convicted of possessing or distributing CSAM. As a result of this they are recommending the following changes;
- P.C. 311.11(a) moved from Lifetime Tier 3 down to Tier 1 (10 years)
- P.C. 288(c)(1) moved to Tier 2 (20 years)
- P.C. 288.2-288.4 moved to Tier 1 (10 years)
Notably these are only recommendations being considered by the board and these changes to the Tiered Registry Law will be included in the boards' annual report which will be finalized during its next meeting to be held in person in Pasadena on January 18, 2024. CASOMB will not meet in December 2023. Copies of CASOMB’s annual report will be sent to all members of the state legislature.
